% 27.07.2018 EA (OS) No.294/2018 This is joint application under Order XXIII Rule 3 of the CPC and decree holder has filed the execution petition for recovery of money decree in his favour against the judgment debtor. During the pendency of the execution, the matter has been settled between the parties and the learned counsel for the judgment debtor has handed over a demand draft for the sum of 1.05 Crores bearing No.260938 dated 24.07.2018 drawn on Axis Bank in favour of Shri Sanjay Singal. The original draft has been accepted by the learned senior counsel for the decree holder.

It is agreed that this amount shall satisfied all the claims / disputes which the decree holder has against the judgment debtor and

that the decree holder shall also withdraw the criminal complaint under Section 138 of the NI Act pending before learned Trial Court at Patiala House Courts, New Delhi. Learned senior counsel for the decree holder also submitted that there are no other proceedings against the judgment debtor.

In view of above, the application is allowed and the execution stands satisfied. No order as to costs.

The earlier date fixed stands cancelled.
