% 18.05.2016 The present revision petition has been filed under Section 397 Cr.P.C. against the impugned judgment dated 31.07.2014. The petition came up for hearing on 25.03.2015 when it was adjourned to 09.04.2015. On 09.04.2015, none appeared for the parties and the petition was dismissed in default. Vide order dated 30.06.2015, the restoration application filed by the petitioner was allowed and the petition was restored to its original number and at the request of learned counsel for the petitioner, the matter was adjourned to 07.07.2015. On 07.07.2015, notice was issued to the respondent by all modes returnable for

06.08.2015. On 06.08.2015, it was reported that the respondent could not be served for want of complete address and fresh notice was issued returnable for 30.09.2015. On 30.09.2015, none appeared for the petitioner and in the interest of justice, no adverse order was passed and the matter was posted for 10.02.2016. On 10.02.2016, in view of service being not complete, fresh notice was issued to the respondent returnable for today i.e. 18.05.2016. Today again, despite the matter being called thrice, there is no appearance on behalf of the petitioner.

It seems that the petitioner is no more interested in prosecuting the matter.

Dismissed for non prosecution.
