% 24.10.2016 Crl. M.A. No. 11957/2016 (exemption) Allowed, subject to all just exceptions. Application is disposed of. W.P.(CRL) 2310/2016 On the complaint of respondent no. 2, present FIR No. 135/2015 under Section 408 IPC was registered at Police Station Barakhamba Road. On the complaint of petitioner no. 2, a cross FIR No. 143/2015 under Sections 354/34 IPC was also registered at Police Station Barakhamba Road. Petitioners and respondent no. 2 have settled their disputes vide a
Memorandum of Understanding dated 6th April, 2016. Cross FIR has already been quashed today by a Bench of coordinate jurisdiction in case being W.P. (Crl.). No. 1795/2016, in view of the compromise. Dr. Sayed Kamruzzamman Washim, Authorized Representative of respondent no. 2, namely, RUS Education India Pvt. Ltd. is present in Court and submits that compromise has been arrived at between him and the petitioner no. 2 without any undue force, pressure and coercion. He submits that FIR may be quashed.
Keeping in mind that settlement has been arrived at between the parties voluntarily and that cross FIR has already been quashed, in the interest of justice, FIR No. 135/2015 under Section 408 IPC registered at Police Station Barakhamba Road and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
