% 17.04.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 17th February, 2017 passed in W.P.(C) 1432/2017 whereby the respondents were directed to refer the petitioner to the Army Research and Referral Hospital within six weeks for re-examination by a Medical Board comprising experienced eye-specialists. Learned counsel for the petitioner states that despite the aforesaid order, respondents have not referred the petitioner for re-examination till date.

Learned counsel for respondents, who appears on advance notice, on instructions of Mr. D. Srivastava, Sergent, Airforce, states that permission

from Director General Armed Forces Medical Services is being obtained. This Court is of the view that in view of the aforesaid categorical order dated 17th February, 20176, no permission from any authority is legally required.

However, as the learned counsel for respondents, on instructions of Mr. D. Srivastava, Sergent, Airforce, assures and undertakes to this Court that the petitioner's re-examination shall be conducted in accordance with the order dated 17th February, 2017 within four weeks from today, the said statement is accepted by this Court and respondents are held bound by the same.

In view of the aforesaid, the present contempt petition is disposed of as satisfied.
