The present application under Order XXIII Rule 3 read with Section 151 of the CPC seeks the following prayers:

"In view of submissions made above, it is therefore, prayed that the appellants may, kindly, be allowed to withdraw the present matter as settled/compromised, in the interest of justice. Any other relief (s) which this Hon'ble Court deems fit and proper may also be passed, in the interest of justice." 3.

Learned counsel for the applicant submits that due to inadvertence, the site plan which is part of the aforesaid MOU dated 07.04.2026, could not be placed on record.
