The matter was listed for September 13, 2016 which was declared a holiday and therefore is being taken up today. 2.

Having perused the affidavit deposed to by the complainant : respondent No.2, I am constrained to quash FIR No.121/2011 PS Kalyan Puri for an offence punishable under Section 363 IPC. 3.

The FIR as also the affidavit would disclose that the petitioner was friendly with respondent No.2 and as a result the son of respondent No.2 was friendly with the petitioner. It is the case of the petitioner that he took out the son of respondent No.2 for a friendly visit and in the meanwhile on seeing the son missing the FIR in question was registered. the petitioner could be gauged from the fact that he came back with the child. No demand for ransom was ever raised. In the affidavit respondent No.2 has admitted the fact that on various occasions the petitioner and the son of respondent No.2 used to move about i.e. the child voluntarily accompanied the petitioner.

I hereby quash the FIR No.121/2011, PS Kalyan Puri for an offence punishable under Section 363 IPC and proceedings emanating therefrom.
