% 12.08.2016 The revenue has preferred this appeal against an order passed by the CESTAT which was of the opinion that pre-deposit of ` 1 crore in respect of penalty amount of `10 crores was justified having regard to the overall circumstances.

We see no infirmity with the order much less any substantial error warranting inference. The appeal along with pending applications is consequently dismissed.
