O R D E R

% 14.07.2017 The petitioner seeks bail in connection with FIR No.274/2016 dated 14.07.2016 (PS Chhawla) instituted for the offences under sections 307/326/34 of the IPC read with sections 27/54/59 of the Arms Act. The petitioner is stated to be in custody since 02.08.2016 and chargesheet in this case has been submitted. The allegations, as it stands in the FIR is that the informant/complainant who is an auto driver was taken to a dark street, where after covering his face and catching hold of him by one of the accused persons, another accomplice fired at him. The chargesheet which has been annexed with this petition clearly states that co-accused Sanjeev @ Kale had fired at the informant leading to injuries on his person. The aforesaid injury is stated to be grievous in nature. Be that as it may, taking into consideration the fact that the petitioner is only said to have caught hold of the victim, his period of custody, the

submission of chargesheet and the commencement of trial, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on his furnishing a bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Trial Court.

It is made clear that the petitioner shall participate in the trial and any effort of his to either tamper with the evidence or threaten or coerce the informant shall be viewed adversely. Should such an action of the petitioner be reported, the Trial Court would be at liberty to initiate proceedings for cancellation of his bail.

The application is disposed of.
