% 14.01.2016 The present petition has been filed under Section 397 read with Section 401 of Cr. P.C. to challenge the interim maintenance granted to the respondent vide order dated 04.03.2015 passed by the Principal Judge, Family Court.

On 12.05.2015, the matter was adjourned to 3rd August 2015, as the lawyers were abstaining from appearing in Court. On 3rd August 2015, the notices were directed to be issued to respondents and the power of attorney on behalf of the respondents was filed. Today, despite pass over given in the matter, and even in the

post lunch session, nobody is present on behalf of the petitioner to represent his case. It seems that the petitioner is not interested to pursue the present petition. Accordingly the present petition is dismissed for non-prosecution.
