% 12.07.2016 Crl. M.A. No.1193/2016 (Restoration) By this application, the petitioner seeks restoration of the main petition, which was dismissed for non prosecution vide order dated 04.12.2015. Counsel appearing on behalf of the complainant has no objection if the present application is allowed. In view of the aforesaid, the present application is allowed and the petition (Crl. M.C. No. 5345/2013) is restored to its original position.

Application stands disposed of.

Crl. M.C. No. 5345/2013 During the course of hearing, on instructions of the Investigating Officer of this case, learned Additional Public Prosecutor for the State apprised that in the present case, the prosecution has already filed the closure report before the Trial Court. In view of the aforesaid, learned counsel for the petitioner does not wish to press the present petition.
