O R D E R

% 13.04.2017 The petition styled as criminal writ petition invoking the jurisdiction of this court under Article 226 and 227 of the Constitution of India is captioned so as to indicate that the petitioner seeks directions against the respondents - Govt. of NCT of Delhi, Election Commission of the State and Residential Welfare Association of B-1, Vasant Kunj, New Delhi - not to create hurdles in approaching the voters to enforce free and fair election in the process of election notified to be held on 23.04.2017 to elect counsellors for the Municipal Corporations of Delhi, by booking false cases. In the prayer clause, however, the petitioner seeks a direction to the first respondent (the Govt. Of NCT of Delhi) to register an FIR against two specific individuals for "perusing" the first respondent to book false cases against the petitioner in hijacking voters of the area for vested interest and for "not allowing" the petitioner to contest from ward 69-S and for allowing the petitioner to meet the voters of the said area for canvassing and further W.P.(CRL) 1072/2017

for direction to the second respondent to take action against the returning officer of the concerned ward and the observer and for having failed to create atmosphere for free and fair election and for lodging FIR against them for criminal conspiracy.

The petitioner has chosen to appear and argue in person. On being asked he stated that his nomination papers were duly accepted and that he is a candidate who has been granted permission to move in the area on a specific vehicle by the concerned authorities in the election. To say the least, the petition is wholly misconceived. General directions as are sought are not called for. The election and all agencies of the State, as indeed all citizens of India are duty bound to ensure that the elections are held in free and fair manner. It is hoped and expected that in case any offences are found to be committed, an appropriate action under the law will be taken by the State agencies.

The petition is dismissed.
