Appellant has filed an appeal for enhancement of the Award dated 25.09.2013 passed by the learned MACT wherein the Insurance Company was given right to recover the awarded amount. 2.
On appeal, the Hon'ble High Court vide order dated 19.12.2013 has stayed the operation of the impugned award dated 25.09.2013 subject to the appellants depositing a sum of Rs.4,00,000/- with the Registrar General of this Hon'ble Court. In compliance of the order dated 19.12.2013, the appellants have deposited DD no. 864179 dated 21.01.2014 for Rs. 4,00,000/- drawn on State Bank of India. We note that the appellants have also deposited Rs.25,000/- by way The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

We have interacted with the Ld. Counsel/parties concerned. Apropos such interaction and deliberations, parties have agreed that the Insurance Company shall be satisfied, if the appellants pay lump sum amount of Rs.13,00,000/- as full and final settlement of the subject matter of the appeal. The appellants have agreed to pay the said amount.

The Appellant is directed to pay Rs. 13,00,000/- to the National Insurance Company within a period of four weeks failing which same shall carry interest @ 9% per annum on the delayed payment and an Appellant is directed to pay the said amount in the name National Insurance Company by way of Demand draft/cheque and the same be handed over to the Authorized Representative of the Insurance Company or through Sh Pankaj Seth, learned counsel for Insuance Company.

In view of the above, Registrar General is directed to refund the amount of Rs 4,00,000/- deposited by the Appellant alongwith the interest as well as the amount of Rs 25,000/- with interest, if any, to the Appellant No. 1 subject to fulfillment of all the requisite formalities.

After the compliance of the Order, the Insurance company shall not press the Execution Petition No. 34/2013 and shall withdraw the said Execution Petition.

In terms of the above, the appeal is disposed off with directions in terms of the settlement.
