O R D E R

% 17.04.2017 (1) Present petition under Section 482 Cr.P.C. has been preferred by the petitioners for quashing of FIR No.374/2010 under Section 420 IPC registered at Police Station Hari Nagar. It is stated that the matter has been settled with the complainant/respondent No.2 amicably before Mediation Centre, Tis Hazari Courts.

(2) Respondent No.2-complainant is present before the Court along with his counsel. The Investigating Officer present in the court has identified him. I have enquired from the complainant whether the matter has been settled with the petitioners amicably without fear and CRL.M.C. 1494/2017

pressure. He has informed that the matter has been settled without any fear or pressure and he has no objection to the quashing of the FIR.

(3) The petition is supported by the affidavits of the parties. Settlement/Compromise deed dated 21.09.2013 signed by the parties before Mediation Centre, Tis Hazari Courts is on record. Pursuant to the settlement a sum of `20,000/- (in cash) has been received by the complainant out of court.

(4) FIR No.39/2010 under Sections 420/467/468/471/506 IPC registered at Police Station Hari Nagar (in connected Crl.M.C.No.1495/2017) against the present petitioners has also been quashed today.

(5) Since the complainant/Respondent No.2 has voluntarily settled the dispute with the petitioners, no useful purpose will be served to continue with the proceedings. In the interest of justice and to put an end to the litigation, FIR No.374/2010 under Section 420 IPC registered at Police Station Hari Nagar and all the proceedings emanating therefrom are quashed.

(6) The petitioners are, however, burdened with costs of `10,000/- to be deposited with Prime Minister National Relief Fund within two weeks. The Registry shall ensure the compliance of the order. (7) The petition is disposed of accordingly.
