% 30.09.2019 After some arguments, counsel for the petitioner seeks permission to withdraw the present petition with liberty to argue on charge by taking all plea including the plea taken in the present petition. Since the incident is of the year 2013, FIR is of the year 2015 and summons issued to the petitioner on 02.11.2016, however, till date, the arguments on charge of the petitioner has not been heard. Accordingly, the Trial Court is directed to hear the petitioner and if required to the other side, pass the order on charge within two months from the next date of hearing fixed before the Trial Court. The petition is disposed of, accordingly.

Needless to state that if the petitioner is aggrieved by the order passed by the Trial Court, he is at liberty to challenge the same before the appropriate Forum.
