O R D E R

The petitioners have filed the present petition, inter alia, praying as under:- "a) allow the present writ petition;

b) to issue a writ of mandamus directing the Respondent No.2 to permit the boys volleyball team of the Petitioners clubs to participate in the forthcoming "Delhi State Senior Men and Women Championship, 2013" being organized on 12.12.2013 to 15.12.2013;

c) to issue such writ or writs or pass such other order or orders as are deemed fit and proper in the facts and circumstances of the case.

d) issue a writ of mandamus directing the Respondent No.2 to hold open trials for selecting the Delhi State Team for the National Championship thereby granting opportunity to all the players to participate in the said open trials;

e) Direct the Respondent No.3 and/or Delhi Administration to appoint experts for holding the selection trails for selection of the Delhi State Team for national championship scheduled for 21.12.2013;

f) issue writ of mandamus thereby directing the Respondent No.2 to lay down rules and regulations for conduct of volleyball championships/tournaments by Respondent No.2; g) issue a writ of certiorari calling for the records relating holding of championship and selection of Delhi State Teams during the year 2011 to 2013."

In so far as prayer (f) is concerned, respondent no.2 had on 05.01.2015 conceded that the said prayer be allowed and had sought time to place the rules and regulations on record. In compliance with the said order, respondent no.2 has placed the rules and regulations of the Delhi Volleyball Association which, inter alia, includes the eligibility criteria for participation in various tournaments.

The Learned counsel appearing for the petitioner states that although the said regulations have been field, the same have not been framed in accordance with the constitution of respondent no. 2 (Delhi Volleyball Association). No foundation for such allegation is laid in the petition. Hence, this Court does not consider it apposite to examine this controversy in the petition. In the event, the petitioner is aggrieved by any provision of the said rules and regulations or the manner in which they have been framed, it would be open for the petitioners to file an appropriate proceedings. Needless to state that same would be considered in accordance with law. 4.

Insofar as the prayers regarding permitting the petitioner clubs to participate in the Delhi State Senior Men and Women Championship, 2013 is concerned the said prayers have become infructuous. No such relief can

be now granted.

The petitioners have further prayed that respondent no.2 be directed to hold open trials for National Championship. The learned counsel for respondent no. 2 states that respondent no.2 has been holding open tournaments for selecting teams for National Championship and therefore the petitioner's grievance is illusory. In view of this statement, the learned counsel for the petitioner submits that the petitioner would be satisfied if the due publicity is given to such open tournaments (trials) and the respondents advertise the holding of such selection trials at least one month prior to such trials, in a national daily having sufficient circulation. It is so directed. In addition, respondent no.2 shall also ensure that the information as to holding of trials for the national championship are placed on the Net. In the event the respondent does not have a website of its own, it would use the other social media platforms (such as facebook) for dissemination of this information. 6.

The petition is disposed of with the aforesaid directions. No further orders are required to be passed in the present petition. VIBHU BAKHRU, J OCTOBER 10, 2017 pkv
