No. 2830/2016 and the stay application were dismissed with liberty to raise the pleas before the learned Trial Court. In view of the averments made in the application order dated 16th September, 2016 is modified and Crl. M.A. No. 2830/2016 and Crl. M.A. No. 12072/2016 are dismissed as withdrawn with liberty to file a fresh petition before this Court taking all the pleas and challenging the order of summoning as well.
