CORAM:
HON'BLE MS. JUSTICE MUKTA GUPTA
O R D E R
% 05.08.2016 Crl.M.A. 11941/2016 Exemption allowed subject to just exceptions. CRL.M.C. 2800/2016 By the present petition, the Petitioner seeks quashing of FIR No. 180/2014 under Sections 354/354A IPC registered at PS Kalkaji, Delhi on the complaint of Respondent No.2 as the parties have settled the matter. Learned APP for the State on instructions from Investigating Officer states that besides the Petitioner there is no other accused involved in the FIR and besides Respondent No. 2 there is no other complainant/victim. Respondent No. 2 is present in Court and is identified by the Investigating Officer. She states that the dispute between the parties arose CRL.M.C. 2800/2016
when she went to take her balance salary and since the parties have settled the matter now she does not wish to pursue above-noted FIR and the proceedings pursuant thereto. She states that she has received `30,000/- by way of demand draft No.'771015' dated 6th June, 2016 drawn on Union Bank of India in lieu of all her claims of salary due towards New Look Lazer Pvt. Ltd., Noida Branch from April to June 2013 and she has now no claim towards the company or the petitioner.
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
Consequently, FIR No. 180/2014 under Sections 354/354A IPC registered at PS Kalkaji, Delhi and proceedings pursuant thereto are hereby quashed.
Parties have signed this order sheet in acknowledgment of their statements made before this Court.
The petition is disposed of. Order dasti.
