% 10.04.2018 The Plaintiff and Defendant are brother and sister. The plaintiff has filed the present suit for partition, declaration, rendition of accounts and recovery against the Defendant in respect of the estate of their deceased father i.e. Late Mr. Vir Khanna. During the course of the proceedings the matter has been amicably settled in the Mediation Centre vide Settlement Agreement dated 16th March, 2018. The terms of the settlement are given in para 8 of the agreement. Both the parties voluntarily and without any undue influence have agreed to the terms of the Settlement Agreement dated 16th March, 2018 and shall endeavour to abide by the same. The decree is passed in terms of para 8 of the Settlement Agreement Ex.C-1. Since the matter is settled in the Mediation
Centre, the court fees be refunded to the plaintiff as per the provisions of the Court Fees Act.
