% 31.07.2018 It is submitted that petitioners and respondent nos. 2 to 5 are neighbours. A quarrel took place between them on some trivial issue wherein respondent nos. 3 to 5 sustained injures. The said incident led to registration of FIR No. 10/2016 under Sections 452/308/354/323/34 IPC at police station Karawal Nagar on the complaint of Manish (respondent no.2). A cross FIR No. 11/2016 under Sections 308/452/354/34 IPC was registered against the respondent nos. 2 to 5 at police station Karawal Nagar, on the complaint of Ashok Upadhyay (petitioner no.2). It is further submitted that disputes involved in the present FIR as well
as in the cross FIR have been settled between the parties vide Settlementcum-Compromise Deed dated 20th July, 2018. Respondent nos. 2 to 5 are present in Court and have been identified by ASI Yashpal Singh of police station Karawal Nagar. They submit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion. They have no objection in case present FIR and the consequent proceedings are quashed.
Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 to 5 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR No. 10/2016 under Sections 452/308/354/323/34 IPC registered at police station Karawal Nagar and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
