O R D E R

The petitioner has filed the present petition praying that directions be issued to the concerned SHO to release the applicant on bail in the event of his arrest in connection with FIR No.304/2018 registered at PS Amar Colony.

It is stated that the petitioner has joined the investigation; the investigation is already complete and a chargesheet has already been filed. The complainant had relied upon certain transcripts of a chat between the petitioner and the complainant which, prima facie, indicates that the petitioner had admitted guilt. The status report now filed indicates that the transcripts of the said chat are not a part of the original chat record as per the data retrieved.

In any view of the matter, this is not a case where the petitioner is not cooperating with the Investigating Officer and the investigation is now complete. There is, thus, no requirement to take the petitioner into custody at this stage.

In view of the above, the present petition is allowed. The petitioner is granted anticipatory bail in connection with FIR No.304/2018 registered at PS Amar Colony. This is subject to the petitioner furnishing a bail bond in the sum of ₹20,000/- and one surety of the like amount, subject to the satisfaction of the concerned trial court. The petitioner shall also not leave the country without the permission of the concerned trial court. He shall also ensure his presence before the trial court on all occasions. Further, the petitioner shall not try and contact the complainant or, in any manner, influence any of the witnesses.

Needles to state that if any of the above conditions are not complied with, the bail granted to the petitioner shall be cancelled. 6.

The pending applications also stand disposed of. 7.
