O R D E R

% 21.04.2016 The present is an application under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No.79/2011 under Sections 420/467/468/471/120B IPC registered at Police Station- Malviya Nagar, New Delhi.

It is an admitted position that the applicant has been on interim bail since 12.12.2013 and has joined investigation in the subject FIR on numerous occasions since then. The applicant is stated to have been the Branch Manager of the Indian Bank, Saket Branch, at the relevant time and has since retired from that post. It is further admitted that the applicant has clean antecedents and no other case is registered against him.

In my view, in view of the foregoing custodial interrogation of the applicant is not warranted in the present case. Resultantly, the interim order dated 12.12.2013 which has remained in operation till the present time is made absolute. In the event of his arrest the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the

arresting officer/Station House Incharge subject to the condition that he shall continue to co-operate with the investigation and shall appear before the court of competent jurisdiction as and when directed to do so. The application is disposed of accordingly.
