On the last date of hearing, two bankers'

cheque of Rs.12,61,690.96 each favouring Mr. Mohit Gupta was handed over to the respondent.

Both the learned counsel appearing for the parties submit that there can be no controversy inasmuch as decree has to be executed in terms of the judgment passed by the trial court read with the modifications to the decree dated 10.11.2015 as passed by this court in RFA Nos.111/2016 and 113/2016.

As per the order dated 15.7.2016, the executing court had directed that the Nazir of the court shall calculate his own amount after tallying the same with the statement of accounts which has been filed and thereafter warrants of attachment are to be issued. CM(M) Nos.745-746/2016

The order dated 15.7.2016 is modified to the extent that Nazir shall make his calculations and the petitioner would be given an opportunity to scrutinize the said calculation and file any statement of account which he may desire.

Thereafter, after calculating the amount payable, steps will be taken as per the orders of the trial court/High Court.

The learned counsel for the petitioner states that copy of the TDS certificate has been handed over to the learned counsel for the respondent today. The learned counsel for the respondent may check the same and intimate to the petitioner in case of any discrepancy. 6.

In view of the above, both the petitions stand disposed of. JAYANT NATH, J.
