% 18.01.2019 The learned senior counsel, on instructions, submits that the petitioner though not having complied with the directions in the order dated 16.07.2018 till date, now understands that he is obliged to do so and undertakes not to make any further default and to appear before the concerned Magistrate forthwith and thereafter cooperate with the process in accordance with law.

The learned senior counsel also submitted, on instructions, that he may be permitted to withdraw the present petition and the application filed therewith, the petitioner reserving his contentions set out in the petition to be agitated as defences before the trial court. CRL.M.C. 2812/2016

The petitioner is bound by the undertaking given as to his appearance.

The petition and the application filed therewith are dismissed as withdrawn.

The withdrawal of the petition under Section 482 Cr. PC will not be construed as reflective of any opinion of this court on the contentions of the petitioner.
