1. A short affidavit has been filed by the Assistant Director of the National Crime Record Bureau stating that pursuant to the order passed by this Court on 18th February 2018, stating that the Ministry of Home Affairs submitted a proposal for revision of pay scales of Constables (Crime Records, Administration and Training Division) of the NCRB at par with the CAPFs to the Department of Expenditure (DoE). By a communication dated 22nd February 2019 the DoE agreed to the proposal from a prospective date.

2. Consequent thereto the NCRB has on 25th February 2019 issued an order revising the pay scales of Constables of Crime Records, Administration and Training Division from Level 1 of the Pay Matrix (Pre-revised Pay Band-1

with Grade Pay Rs.1800/-) to level 3 of the Pay Matrix (Pre-revised Pay Band-1 with Grade Pay Rs.2000/-) with immediate effect.

3. The grievance of the Petitioners' counsel is that the revision should have been given effect retrospectively from 1st January 2006 or at least from the date when the Petitioners approached this Court i.e. 9th December 2013.

4. The Court permits the Petitioners to make a representation to the Respondents for giving retrospective effect to the aforementioned pay revision. If such representation is made within a period of four weeks from today, it will be considered on merits with reference to any other precedent that may be available with the Respondents and a decision thereon be communicated to the Petitioners within a period of twelve weeks thereafter.
