O R D E R

% 14.07.2017 In the FIR, the prosecutrix has stated that Petitioner was having an affair with her over the last two years. During the said period he forced her to have sexual relations with her on the promise of marrying her. She became pregnant; her pregnancy was terminated. The Petitioner took her to Ajmer and Punjab and they stayed there in a hotel as husband and wife. On their return to Delhi, their family came to know about their relationship.

Complaint was lodged in Police Station Nihal Vihar, however, the matter was compromised. Petitioner used to beat her. On 13.02.2016, the prosecutrix and the petitioner shifted to some other location from their previous residence. Petitioner told her that she should go to her parents' house and bring money by demanding her share in the house. Dowry was

demanded. Petitioner also threatened her that in case the dowry was not given, he will not marry her.

Learned counsel for the Petitioner submits that as per the FIR itself, it is apparent that there was live-in relationship between the parties. It is further submitted that marriage was also solemnized on 04.02.2016 as per the Muslim rites and ceremonies after the petitioner embraced Islam, since the prosecutrix is a Muslim lady. Learned APP has opposed the application. It is submitted that the Petitioner had sexual relations with the prosecutrix on the pretext of marriage but later he backed out.

Keeping in mind the totality of the facts and circumstances as narrated above, it is ordered that in case of arrest, the Petitioner be released on bail subject to his furnishing personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of the Arresting Officer/IO/ SHO, Police Station Police Station Nangloi, Delhi.

The Bail Application is disposed of.
