This is an application under Order 23 Rule 3 CPC in an interpleader suit. Defendant nos. 1 and 2 have compromised their disputes interse and a a copy of the settlement deed dated 13.1.2016 has been filed alongwith the application.

Accordingly, the application is allowed and the interpleader suit is disposed of in terms of the settlement deed 13.1.2016. Counsel for defendant no.3 states that defendant no.3 does not claim any rights in the amounts which are subject matter of the interpleader suit. Plaintiff has already deposited the amount in this Court as per the interpleader suit. In terms of
the settlement deed the entire amount deposited in this Court alongwith accrued interest thereon shall be paid to defendant no.2. Therefore, the amount deposited alongwith accrued interest thereon be paid by the Registry of this Court to defendant no.2.
Defendant nos. 1 and 2 who are parties to the settlement deed dated 13.1.2016 will be abide by terms as stated in the settlement deed. Parties are left to bear their own costs. VALMIKI J. MEHTA, J MARCH 01, 2016 ib
