O R D E R

% 22.08.2016 The learned counsel for the respondent No. 3 submits that this writ petition is not maintainable against the school. This submission on behalf of the said respondent is quaint, to say the least, considering that the State is duty bound to enforce the statute which governs organisation, development and administration of schools in Delhi as per Sections 8 & 10 of the Delhi School Education Act, 1973, all schools, aided or unaided are liable to pay salary, allowances etc. to their employees in terms of the applicable laws. The petitioner has sought payment of gratuity due to her, leave encashment etc., which have allegedly been denied by the respondent Nos. 1 & 2. Representations to respondent Nos. 1 & 2 have yielded no results. In view of the above, it is directed that for the enforcement of her rights, this writ petition will be treated by respondent No. 3 as representation on which the respondent No.3 shall take appropriate action after giving due

notice to respondent Nos. 1 & 2 for enforcement of her rights, as may be available to her in law. The respondents shall decide this representation within 12 weeks from today with a speaking order. The writ petition is disposed off in the above terms. NAJMI WAZIRI, J AUGUST 22, 2016/acm
