% 30.10.2019 It is not in dispute that after separation, the petitioner left the flat wherein petitioner and complainant were staying in the year 2016 and thereafter, the complainant continued to stay in that flat for one year. The petitioner has specifically stated in the reply to the list of dowry articles given by the complainant that he has no dowry articles of the complainant whereas the complainant, who is personally present in Court, has disputed the said fact and submits that jewellery articles are in possession of mother of the petitioner which have not been returned. SI Jyoti, who is present in Court, has informed this Court that pursuant to the directions of this Court, the petitioner has joined the investigation and charge-sheet is ready and thus, no further interrogation is required from the petitioner.
In view of the above, the Arresting Officer/IO concerned, is hereby directed that in the event of arrest, the petitioner/ applicant shall be released on bail on furnish a personal bond in the sum of ₹25,000/- with one surety in the like amount subject to the satisfaction of Arresting Officer/IO concerned.
