O R D E R

% 18.01.2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.472/2013, under Sections 379/380/411/448/406/506/34 IPC, registered at Police Station Mayur Vihar, Phase-I, East Delhi and all the proceedings emanating therefrom.

Learned counsel for the petitioners submitted that the petitioners and respondent No.2 & 3 are close relatives as the respondent No.2 is the real aunt (Bua) of the petitioners and the respondent No.3 is husband of respondent No.2. He further submits that there was a dispute between them pertaining to the immovable property, which resulted in registration of the aforesaid FIR. He also submits that after the registration of FIR, they have settled all their disputes with the help of near relatives and close friends and the same was reduced into writing vide Settlement Deed dated 05.01.2014

and that nothing remains to be adjudicated upon between the parties further. He further submits that since all the disputes have been settled between them and also the petitioners and the respondent Nos.2 &3 are close relatives and in order to have better relation in the near future, the FIR in question and all proceedings arising therefrom may be quashed. The respondent No.2 is present in Court today and has been identified by the Investigating Officer, SI Anuj Kumar, P.S. Mayur Vihar, Delhi. The complainant also admits that the matter has been amicably settled with the petitioners vide Settlement Deed dated 05.01.2014 and she has no claim or grievance left against the petitioners. She further submits that the settlement/compromise has taken place voluntarily, without any force, pressure or coercion and that she has no objection, if the FIR in question is quashed.

Keeping in view the facts and circumstances of the case and the fact that the matter is between close relatives and also that matter has been amicably settled between the parties vide Settlement Deed dated 05.01.2014, the FIR No.472/2013, under Sections 379/380/411/448/406/506/34 IPC, registered at Police Station Mayur Vihar, Phase-I, East Delhi and all proceedings arising of the same are hereby quashed. Parties to remain bound by the terms of Settlement Deed dated 05.01.2014.

The present petition is disposed of accordingly. Copy of this order be given dasti.
