Crl.M.A.No.16059/2016 (Delay in re-filing) For the reasons mentioned in the application, the delay of 60 days in re-filing the present petition is condoned.

Accordingly, this application stands disposed of. CRL.M.C. 3834/2016 The present petition has been preferred by the petitioner for quashing of FIR No.543/2013 under Section 324 IPC registered at P.S. Amar Colony, New Delhi Learned counsel for the petitioner submits that the petitioner has amicably settled the matter with the respondents No.2 and a settlement has been arrived at between the parties before the Mediation Centre at Saket

Courts, New Delhi with the intervention and help of near relatives and friends in order to maintain good relations and peace amongst the parties. He further submits that the petitioner and complainant are the neighbourers and due to some misunderstanding between them a quarrel had taken place, which later on, with the help of friends and relatives has been sorted out and therefore, they have approached this court for quashing of the FIR. The respondent No. 2/ Smt. Rajender Kaur is present before the Court today. The IO/ SI Ram Naresh from P.S. Amar Colony, Delhi is present and has identified the complainant. I have enquired from respondent No.2 whether the matter has been settled with the petitioner without fear and pressure. She has stated that the matter has been settled without any fear or pressure and there is no dispute among them and that she has no objection to the quashing of the FIR in question. Learned APP for State states that he has no objection if the proceedings are quashed as the dispute between the parties has been amiably settled.

Since the matter has been settled between the parties, no useful purpose will be served to continue with the proceedings under Section 324 IPC. In the interest of justice, FIR No.543/2013 under Section 324 IPC registered at P.S Amar Colony, New Delhi and all the proceedings arising therefrom are quashed.
