O R D E R

% 25.04.2017 The petitioner, who is a teacher in a government school, seeks quashing of FIR No.1372/2014 dated 12.11.2014 (P.S. New Ashok Nagar) instituted for offences under Section 308 IPC. The petitioner is said to have thrown a stick on Vishal, a student of the same school where the petitioner is teaching, leading to injuries on his head.

The a petitioner states that two boys were fighting amongst themselves and Vishal, the victim, was only an onlooker. There was no intention on the part of the petitioner to cause any injury to Vishal. In fact, the petitioner was only trying to pacify the two other students who were fighting and in the process, Vishal got hit accidentally. Considering that there was no intention on the part of the petitioner to inflict any injury on Vishal, the father of the victim, by an agreement, stated

that he is no longer interested in pursuing the subject FIR. Though Vishal is said to have received injuries but considering the circumstances in which he received injuries and the fact that the petitioner has been a teacher, who was only trying to pacify the dispute between two students in which Vishal was accidentally hurt, this court is of the view that no useful purpose would be served in continuing with the investigation in this case.

For the reasons stated above, the FIR No. 1372/2014 (P.S. New Ashok Nagar) and all the proceedings emanating therefrom are quashed. The petition is disposed of.
