A plain reading of the petition also indicates that there is no averment that the possession of the subject land has not been taken over. The abovecaptioned petition was filed, inter alia, praying that the acquisition in respect of the land falling in Khasra Nos.7/20 (0-19), 7/21 (4-08), 10/1 (4-16) full share and 1⁄4 share of 9/14 (3-17), 9/15 (4-16), 10/11 (4-16), 10/12 (4-16) in the revenue estate of village Badarpur had lapsed by virtue of Section 24(2) of the Right to Fair Compensation and Transparency of Land Acquisition, Rehabilitation and Resettlement Act, 2013. Although, it is pleaded that compensation for the subject land was not paid but there is no averment to establish that the condition regarding possession not being taken over is satisfied.
