O R D E R

% 24.04.2015 It is not in dispute that petitioner's wife has undergone uterus removal surgery on 3rd April, 2015. She needs post operative care. Petitioner had filed present writ petition for extension of parole period earlier granted to him vide order dated 10th March, 2015 passed in W.P. (Crl.) 495/2015. Petitioner had filed this petition before expiry of parole period, however, the same could not be listed earlier in view of office objections and has been listed today. During this period, petitioner has surrendered in jail on 20th April, 2015 on completion of parole period. Since petitioner has already surrendered on expiry of parole period earlier granted to him, present writ petition is treated for grant of parole.

In my view, presence of petitioner is necessary to take post operation

care of his wife. Accordingly, it is ordered that petitioner be released on parole for a period of 15 days subject to his furnishing a personal bond in the sum of `10,000/- with one surety in the like amount to the satisfaction of the jail superintendent. During the period petitioner remains out on parole, he shall report to the SHO, P.S. Hapur, Uttar Pradesh once a week, that is, on every Monday at 10:00 am. Petitioner shall surrender immediately on expiry of parole period before the Jail Authorities. Writ petition is disposed of in the above terms. Copy of the order be given dasti to the counsel for the petitioner. A.K. PATHAK, J.
