Mr. Ripu Daman Bhardwaj, who, appears on advance notice on behalf of the respondent says that the petition is not maintainable given the nature of the relief sought by the petitioner. Learned counsel further informs me that the tenure of the subject agreement expires tomorrow i.e., on 02.08.2018.

To be noted, Mr. Abhijat on behalf of the petitioner seeks to contend that the apparent disinclination of the respondent in not wanting to exercise discretion in favour of the petitioner to extend the tenure of the agreement is unfair and borders on arbitrariness.

However, upon hearing the objection advanced by Mr. Bhardwaj, Mr. Abhijat seeks leave to withdraw the petition and take recourse to an appropriate remedy in a manner known to law.

The petition is dismissed as withdrawn with liberty as prayed for. 6.
