% 08.09.2017 The present application is filed for anticipatory bail of applicant/petitioner. Vide order dated 21.04.2017, the petitioner was granted interim protection. Counsel for the petitioner submits that the petitioner is unable to return to India from United States of America as he has got a job and joined a new company. He further submits that he wishes to withdraw the present petition with liberty to file a fresh petition, as the petitioner is presently residing in United States of America.
Separate statement of counsel for petitioner is recorded. Even otherwise the petition for anticipatory bail seeking protection has become infructuous as the petitioner has not returned to India. Leave as prayed for, is granted.
Accordingly, the present petition is dismissed as withdrawn and having became infructuous.
