% 12.03.2018 It is contended by the learned counsel for the petitioner that he has instructions to withdraw the writ petition. It is noted that such a statement was made even on July 18, 2017, but the withdrawal of the writ petition was not agreed to.

Today, it is represented by Mr. Kirti Uppal, learned Sr. Counsel appearing for respondent no.3 that the said respondent has approached the ATMCD and on December 5, 2017, the Appellate Tribunal had granted stay in favour of respondent no.3 with regard to property bearing no. 1153, Kucha Mahajani, Chandni Chowk, Delhi - 110006. According to him, the next date of hearing is March 22, 2018.

Mr. Mukesh Gupta, learned Standing Counsel appearing for respondent no.2 states North Delhi Municipal Corporation is being represented before the ATMCD.

In view of the submissions made by the counsel for the petitioner and the fact that the respondent no.3 has already approached ATMCD which has stayed the demolition, I do not think any purpose would be achieved to retain the present petition.

The petition and the connected applications are dismissed as withdrawn.
