% 05.08.2016 This matter has been received upon special mentioning. Present writ petition has been filed in this Court as the Bench of Telecom Disputes Settlement & Appellate Tribunal (TDSAT) is not available.

Learned counsel for the petitioner states that his matter is listed before TDSAT on 8th August, 2016.

Since this Court is of the view that the petitioner should not be condemned unheard, it directs that either till 8th August, 2016 or till TDSAT hears the petitioner's case, whichever is later, the impugned disconnection notice should not be given effect to. Ordered accordingly.

With the aforesaid directions, present writ petition and the applications stand disposed of. This Court clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open. MANMOHAN, J AUGUST 05, 2016 KA
