% 26.05.2017 The present petition has been filed against the order dated 25.02.2017 vide which the DCP directed to treat the FIR No.01/2017, under Section 376 IPC, Police Station Malviya Nagar as "Zero" FIR and transferred the same to Bangalore.

The admitted position is that after the passing of order dated 25.02.2017, the Bangalore police has already registered the FIR vide No.146/2017, Police Station Madanaykanally, District Bangalore Rural.

This Court is of the opinion that the Bangalore police has already seized of the matter and started the investigation in the matter. Undisputedly, the proceedings initiated and continuing with the Bangalore police is not the subject matter of this Court. In view of the facts and circumstances and the consequence of order dated 25.02.2017 particularly when the matter is with the

Bangalore police, no order can be passed by this Court. However, the petitioner is at the liberty to question the jurisdiction of Bangalore police with the High Court of Karnataka, if so desires. The present petition and application Crl.M.A. 6410/2017 are disposed of accordingly.
