O R D E R

% 28.01.2016 In view of notification no 27187/DHC/Orgl. Dated 24.11.2015 & in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), which came into force with effect from 26.10.2015 vide Notification No. F. No. L-19015/04/2012-Jus dated 26.10.2015 issued by the Government of India, Ministry of Law, Justice & Company Affairs, published in Gazette of India Extraordinary, Part-II, Section 3 Sub Section (ii), the present matter stands transferred to the jurisdictional subordinate courts.

Defendant No.2 is reported to be unserved.

Plaintiff be directed to take fresh steps for the service of defendant No.2 as per the order dated 28.10.2015. Steps be taken within two weeks time.

Learned counsel for the plaintiff seeks time to file rejoinder to reply of IA (u/O VII Rule 11 CPC).

Plaintiff be directed to file rejoinder to the reply of the said IA within two weeks time with advance copy to the other side. IA No. 1218/2016 (u/O VI Rule 17 CPC filed by the plaintiff) Notice of this IA accepted by counsel for the defendant and seeks time to file reply to this IA.

As such, be directed to file reply to this IA within two weeks time with advance copy to the other side followed by rejoinder, if any, within two weeks time thereafter.

Learned counsel for the parties further submits that the valuation of the suit property for the purpose of pecuniary jurisdiction is less than two crores and the suit property is situated at Burari which falls within the jurisdiction of Central District and requests to send the matter to the Ld District & Session Judge (Central District), Tis Hazari Court, Delhi.

Hence, in view of the submission and circumstances, the matter be sent to the Ld District & Session Judge, (Central District) Tis Hazari Court.

Parties be directed to appear before the Court of Ld District & Session Judge (Central District), Tis Hazari Court on 05.05.2016. The suit files be made available to the Ld District & Session Judge (Central District) at Tis Hazari Court on the date fixed. DR.
