% 21.04.2015 This writ petition is directed against the Order in Original No.

05/DPS/Policy/2014 dated 05.12.2014 passed by the Commissioner of Customs (Gen).

The said Order in Original is appealable and the appeal lies to the Excise, Customs and Service Tax Appellate Tribunal, New Delhi. The learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition with liberty to file the appeal before the said Tribunal. He also requests that the Tribunal may be directed to dispose of the appeal so filed expeditiously. The writ petition is dismissed as withdrawn with the aforesaid liberty. In case, the appeal is filed within a week, the Tribunal shall endeavour to dispose of the same at earliest.
