% 25.10.2017 Learned counsel for the plaintiff states that as defendant no. 2 was only a manufacturer, he does not wish to press the suit against the said defendant. Accordingly, defendant no. 2 is deleted from the array of parties. Let an amended memo of parties be filed within one week. Learned counsel for the defendant no. 1, on instruction of Mr. Karan Mehrotra, Director of defendant no. 1-Company who is personally present in Court, undertakes that the said defendant shall manufacture the medicine in question under the mark MAXIGLA as one word with same font and single colour.

The statement/undertaking given by learned counsel for the defendant no. 1 is accepted by this Court and the defendant no. 1 is held bound by the same.

In view of the aforesaid statement, learned counsel for the plaintiff gives up prayers in paragraph 24(iii) to (vii) of the plaint. He also has no objection to the disposal of the present suit. Accordingly, present suit is decreed in terms of aforesaid statements/undertakings and paragraph 24(i) and (ii) of the plaint. Registry is directed to prepare a decree sheet.
