% 04.02.2019 Learned counsel appearing for respondent No.

3/Delhi Cantonment Board has handed-up a copy of communication dated 11.01.2019, whereby respondent No. 3 has accorded sanction for construction of the building on the petitioner's property, subject of course to the terms and conditions of such sanction. Accordingly, the previous orders made by this court have been complied with, inasmuch as the application seeking sanction of building plans has been approved.

In this view of the matter, order dated 29.02.2016 that was impugned by way of this writ petition is rendered invalid and stands superseded by the sanction of building plans granted by the communication dated 11.01.2019. Consequently the breach of clause 1(8) of the lease also stands condoned.

A copy of the communication dated 11.01.2019 aforesaid is taken on record.

Mr. K.C. Mittal, learned counsel appearing for the petitioners states that in view of building plans having been sanctioned, the prayers made in this writ petition stand satisfied. The writ petition is accordingly disposed of. ANUP JAIRAM BHAMBHANI, J.
