With the consent of the parties, the impugned award dated 14th June, 2016 is set aside. The parties agree that the disputes pertaining to the tripartite agreement dated 23.12.2010 be also referred to arbitration under the aegis of Delhi International Arbitration Centre (DIAC). 2.

The learned counsel for the parties state that Mr. P. Raghunathan has been appointed as an arbitrator to adjudicate the disputes between them in respect of agreements dated 11.03.2011 and 01.05.2012. Accordingly, Mr. P. Raghunathan is appointed as an arbitrator to adjudicate the disputes in relation to agreement dated 23.12.2010 as well. The parties shall appear before the Co-ordinator, DIAC on

15.05.2017 at 11:00 AM. The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules. 3.

The petition stands disposed of.
