% 02.12.2016 Statement of the petitioner has been recorded in court. He has undertaken to vacate the property in question on or before 01.12.2017. Other terms and conditions have also been stated by him in his undertaking. He shall remain bound by his undertaking.
In view of the above undertaking, learned counsel for the petitioner submits that he does not wish to pursue the present revision petition. Learned counsel for the respondent submits that in view of the undertaking of the petitioner, he shall not execute the eviction order till 01.12.2017.
In view of the above, the petition and all pending applications stand disposed of.

RC.REV. 397/2016 Dated: 02.12.2016 STATEMENT OF SH.AVTAR SINGH S/O LATE SH. SARDAR RAGHUBIR SINGH R/O L-32, SHASHTRI NAGAR, NAG MANDIR ROAD, DELHI-110052 AGED ABOUT 70 Years ON SA. I undertake to this court to vacate the property which is the subject matter of the eviction petition, namely, Shop No. 4, Ground Floor in Property No. B-1107, Shashri Nagar, New Delhi-110052 as described in the eviction petition and handover vacant physical possession of the property to the respondent on or before 01.12.2017. I also undertake to the court that I shall pay the agreed monthly rent, electricity and water charges for the period I occupy the premises. I shall not cause any wilful damage or harm to the property or induct any third party into the property. I undertake to this court not to seek any extension of period for vacating the property. I admit the bona fide needs of the respondent.
