% 28.04.2017 The writ petitioner makes a grievance that the respondents have changed the alignment of the metro line between Dwarka and Najafgarh line from an elevated corridor to an underground one. This decision is not in public interest.

Further grievance is made that this decision has been taken to protect the encroachments which exist on the line which would have been a part of the elevated line.

The writ petitioner had earlier filed Writ Petition (C) No. 7232/2016 seeking extension of an existing metro corridor and the said writ petition was disposed of by an order dated 9th August, 2016 directing the petitioner to make a representation.

Certainly, this Court would not have the competence to assess the technical merits or demerits of the decision taken by the respondents with regard to the change of the proposal from elevated corridor to construction of underground metro corridor.

In view of the foregoing, the present writ petition is disposed of with a direction to the respondents to treat the present petition as a representation to them and consider the submissions made by the petitioner therein for construction of the proposed metro corridor between Dwarka and Najafgarh. The said representation shall be decided within a period of six weeks from today, under intimation of the same to the petitioner. The present writ petition is disposed of in the above terms. Pending application also stands disposed of.
