% 21.11.2016 Learned counsel for the plaintiffs has submitted that he has filed the suit against defendants no.1 and 2. However, it reveals that the main violator of their trademark had given his fake identity to defendant no.2 while getting the product advertised. Now, they have come to know the true identity of the violator of their trademark. He seeks permission to withdraw the present suit with liberty to file fresh one against the violator of his trademark.

In view of the submissions of learned counsel for the plaintiffs, the suit along with the pending application is dismissed as withdrawn with liberty as prayed for.
