% 18.02.2016 In this petition the bids for Refreshment Rooms in Ambala Cantt., Kalka and Bhatinda railway stations is the subject matter. Insofar as Ambala Cantt. is concerned, the highest bidder has been indicated as Sree Venkateswara Enterprises who submitted a bid of licence fee of Rs.12,12,122/- per annum. It is an admitted position that even if the petitioners' bids were to be regarded as eligible, neither the petitioner no.1&3 nor the petitioner no.2 gave a higher price bid.

Therefore, they would not be entitled to the Refreshment Room at Ambala Cantt in any event. The same goes for the Refreshment Room at Bhatinda. However, insofar as the Refreshment Room at Kalka is concerned, the petitioner no.2 (Hans Raj & Company) has succeeded inasmuch as it is the sole surviving bidder and in any event the petitioner no.2 was otherwise also qualified. Therefore, in this petition, no further directions are necessary. The writ petition stands disposed of.

The issues raised with regard to the eligibility criteria are left open.
