CRL.M.C. 1531/2017 and Crl.M.A.No.6227/2017 (stay) This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioners for setting aside the order dated 08.03.2017 passed by the learned Metropolitan Magistrate, Patiala House Courts, New Delhi in CC No.38023/16.

Learned counsel for the petitioners submits that vide the impugned order the learned Court below has issued NBWs against the present petitioners. Counsel further submits that the next date of hearing fixed before the Court below is 22nd April, 2017 and the petitioners want to join

the trial and further submits that since NBWs have been issued against the petitioners, they are apprehending their arrest in the above case and prays that the petitioners may be admitted to bail as nothing is to be recovered from or at the instance of the petitioners.

Notice.

Learned APP for the State accepts notice and opposes the petition and submits that there is no merit in the petition and the same is liable to be dismissed.

Heard learned counsel for the parities and perused the record. Since the petitioners have shown their bona fide intention to appear before the Court below and join the trial, in these circumstances, I admit the petitioners on bail, on their furnishing bail bond in the sum of Rs.20,000/- each with one surety each of the like amount to the satisfaction of the concerned Court till the next date of hearing fixed before the Court below i.e. 22nd April, 2017. The petitioners are directed to appear before the Court below on 22nd April, 2017 and move appropriate application for bail which shall be disposed of by the concerned Court in accordance with law. The present petition and stay application are disposed of accordingly. Copy of this order be given dasti, as prayed. I.S.MEHTA, J APRIL 18, 2017 'dc'
