By this petition, the petitioner seeks bail in case FIR No. 132/2018 under Sections 306/506/509 and Section 12 of the Protection of Children from Sexual Offences in short "POCSO Act" registered at PS Alipur. 2.

The above noted FIR was registered after a call was received at 11:30 A.M. on 23rd March, 2018 which was recorded vide DD No. 16A informing the hanging of a girl at village Bakhtawarpur, Delhi. Police reached the spot i.e. shop of Dharm Pal near Kabir Mandir, Village Bakhtawarpur, Delhi where one body of the girl aged 17 years was found lying inside the shop. BAIL APPLN. 1869/2018

On inquiry, statement of the father of the deceased was recorded who stated that his daughter was studying in 12th Standard and the board examinations were going on. The petitioner herein who was also a resident of the same Village used to visit their house on the pretext of getting the girl recruited in Delhi Police. He used to take her out for jogging. On 21st March, 2018 the wife of the complainant informed him about the misbehaviour of the petitioner with their daughter. According to them the daughter informed that while jogging, the petitioner misbehaved with her. On this the complainant along with his wife went to the house of the petitioner where instead of listening to the complainant, petitioner and his family forced them out of the residence. The behaviour was to the extent that the landlord of the complainant asked them to vacate the tenanted premises. Constrained by all these harassment, the deceased committed suicide. 4.

Considering the nature of allegations that it was due to the misbehaviour of the petitioner, on complaint being raised there was misbehaviour with the family of the deceased and they were even forced to vacate the house and the fact that the complainant and his wife are yet to be examined in the witness box, this Court finds no ground to grant bail to the petitioner at this stage.

Petition is dismissed.
