% 02.08.2018 This is a case of electricity theft. Respondent no.2 is an electricity company. It is submitted that petitioners and respondent no.2 have settled their disputes amicably, inasmuch as, petitioners have paid the settled amount to the respondent no.2.
Counsel for the respondent no.2 has not disputes this fact. He says that respondent no.2 has no objection in case FIR No. 388/2015 under Section 135 of the Indian Electricity Act, 2003 registered at police station Sarita Vihar and consequent proceedings are quashed.
Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, inasmuch as, settled amount has been paid to
the electricity company, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
